Who owns what?

Namibian politicians probably wish that ethics (like civil rights in some of their opinions) were a foreign concept or irrelevant to good governance. How else to interpret the disregard for the legal requirement that members of parliament must disclose their interests and assets?
The latest assets register, the first in five years (though the law says there should be one every year), point to lawmakers who care less about their own rules. The assets register is aimed at making public what the country’s elected leaders own and thus help regulate conflicts of interest between their public personas and self-interest.

The declaration of interests and assets of lawmakers stems from expectations of accountable leadership and specifically in the Namibian constitution. Article 42 of the constitution prevents cabinet members not only from taking up employment outside their government jobs but also from engaging in “activities that or exposing themselves to any situation which carries with it the risk of a conflict developing between their interests as ministers and their private interests”. An Act of parliament – Powers, Privileges and Immunities Act 1996 – crystallises that requirement.

Section 22 - Disclosure of interest

  1. A member shall not in Parliament take part in any proceedings in which such member has any interest, whether direct or indirect, which precludes him or her from performing his or her functions as a member in a fair; unbiased and proper manner.
  2. If at any stage during the proceedings in Parliament it appears that a member has or may have an interest, which may cause a conflict of interests to arise on his or her part, that member shall forthwith fully disclose the nature of his or her interest. 
  3. A disclosure contemplated in subsection (2) shall be recorded in the journals of the House or the minutes of the committee concerned, as the case may be.
  4. Subsection (1) shall not apply to any deliberations or vote on any matter concerning the remuneration or allowances or other benefits to be received by members in their capacity as members.
  5. In the event that a member fails to comply with subsection (2), the House may, after investigation and recommendation by the Committee of Privileges in terms of section 12, take such disciplinary action against such a member as it may deem appropriate in accordance with its Standing Rules and Orders.

A part of this ethical requirement is an annual register that lawmakers are expected to submit to the National Assembly and National Council.

  1. SHARES AND OTHER FINANCIAL INTERESTS
  • List all shares and other financial interests in companies and other corporate entities, in or outside of Namibia, including the company name, number of shares, the nature of the shares and the date the shares were acquired. 
  • For purposes of this declaration a share is any investment that provides a dividend, including unit trusts, equities, or government bonds. 
  • A share’s nature may be either ordinary or preferential.

2.    DIRECTORSHIPS, PARTNERSHIPS AND BOARD MEMBERSHIPS

  • List all directorships, partnerships, and board memberships (including membership of a board of trustees) you hold, in or outside of Namibia, including to charitable trusts, sporting or artistic organizations.   
  • Include a brief description of the entity’s activity and the date you started your position as director, partner or board member.
  • The extent of the remuneration received and the size and value of a financial interest in a partnership must be recorded in the confidential section in the space provided with the corresponding number.

3.    SOLE OWNERSHIPS

  • List all enterprises, including farms, of which you are the sole owner and the type of business.
  • Include the date the sole ownership was acquired.
  • The equity value in the sole ownership must be recorded in the confidential section in the space provided with the corresponding number.

4.    REMUNERATED EMPLOYMENT OUTSIDE OF PARLIAMENT

  • List all employment you have other than Parliament for which you are paid in cash or in kind, including the name of the employer, the type of business and the date you were hired.
  • The extent of the remuneration received by you must be recorded in the confidential section in the space provided with the corresponding number.

6.    IMMOVABLE PROPERTY

  • List all immovable property you own in whole or in part including but not limited to land, property you lease, and buildings. 
  • You will disclose the value of your interest in immovable property and the location and value of your private residence in the confidential section.
  • List a brief description of the property, the location of the property, the nature of your interest in the property and the date the property was acquired.
  • ”Nature of interest” means whether you are the sole owner, leaseholder, has a sectional title, or your business enterprise owns shares in immovable property.
  • The equity value in immovable property (which is defined under definitions) must be recorded in the confidential section in the space provided with the corresponding number.

7.    ACCOUNTS WITH FINANCIAL INSTITUTIONS EXCEEDING N$20,000

  • List all accounts with financial institutions, in or outside of Namibia, that exceed N$20 000 during the reporting period.

  • Visits paid for entirely by you, business visits unrelated to your role as a public representative, or formal visits paid for by the government or your political party, are not required to be disclosed. 
  • Where the nature of travel requires confidentiality, the travel must be listed in the confidential section.

  • List all gifts or hospitality received in the reporting period having a value over N$1,000.  
  • This includes any services rendered to you without charge.
  • This also includes any discounts having a value over N$1,000 received by you.
  • Any hospitality intended as a gift in kind must be disclosed.  Hospitality includes but is not limited to food and entertainment.
  • If you receive more than one gift or discount during the reporting period from a single source resulting in a cumulative value over N$1,000, that must be reported here.
  • If you receive hospitality from a single source resulting in a value over N$1,000 in the reporting period, that must be reported here.
  • Exclude personal gifts within the family and hospitality of a specifically traditional or cultural nature.
  • Exclude bequests or other forms of inheritance.
